  • Locate the original will (if any)

  • Obtain certified copies of the death certificate

  • File the will with the Superior Court within 30 days (Probate Code §8200)

  • Identify potential heirs and beneficiaries

  • Determine if probate is necessary (Is the estate under $184,500?)


🏛️ Filing for Probate

  • Complete and file Petition for Probate (Form DE-111)

  • File Duties and Liabilities (Form DE-147)

  • File Order for Probate (Form DE-140)

  • File Letters (Form DE-150) once appointed as personal representative

  • Publish notice in a local newspaper

  • Send Notice of Petition to Administer Estate (Form DE-121) to all interested parties
